1. Platform Nature

AQARIRAQ is a real estate advertising platform only.

AQARIRAQ is NOT:

• A real estate broker or agent
• A legal advisor
• A valuation service
• A party to any transaction

We do not participate in or guarantee any deals.

2. Eligibility

You must:

• Be at least 18 years old
• Have legal capacity under Iraqi law
• Provide accurate information

3. Electronic Contract Acceptance (Binding Agreement)

By accessing, registering, clicking "Accept", creating an account, subscribing to services, or otherwise using the Platform, you:

• Acknowledge that you have read and understood these Terms
• Explicitly agree to be legally bound by them
• Consent to the formation of a valid electronic contract under applicable Iraqi laws governing electronic transactions

Electronic acceptance shall have the same legal effect as a written signature.

4. Account Responsibility

You are responsible for:

• Your account and all activity
• Maintaining secure login credentials

5. Listings and Legal Responsibility

By posting listings, you confirm:

• You have legal authority to advertise
• All information is accurate
• The property is lawful and not disputed

6. Listing Requirements

Listings must:

• Be accurate, clear, and truthful
• Include real property details and images
• Reflect actual availability

7. Document Submission

Users must provide:

• Ownership documents OR
• Authorization from the owner

Important Disclaimer

AQARIRAQ:

• Performs basic checks only
• Does NOT verify authenticity or legality
• Does NOT guarantee ownership or validity

Users rely on listings at their own risk.

8. Prohibited Listings

Strictly prohibited:

• Fake or misleading listings
• Forged or altered documents
• Properties under legal dispute
• Illegal or undocumented properties
• Fraud, money laundering, or deceptive activity
• Duplicate or spam listings

9. Platform Rights

We may:

• Edit or format listings
• Remove content without notice
• Suspend violating accounts

10. Marketing Use

You grant AQARIRAQ the right to:

• Use listings in marketing campaigns
• Promote content on social media

11. Subscription Model

• Paid subscription services
• Based on listing type and package

12. Billing Cycle

• Every two (2) weeks

13. Auto-Renewal

• Subscriptions renew automatically
• Continue until cancelled

14. Cancellation

• Via platform or support
• Effective at end of billing period

15. No Refund Policy

• All payments are final and non-refundable under any condition.

16. No Transaction Involvement

AQARIRAQ:

• Does not handle deals or payments
• Is not responsible for any agreement

17. Disclaimer

Platform provided "as is" with no guarantees.

18. Limitation of Liability

AQARIRAQ is not liable for:

• Fraud or user misconduct
• Invalid documents
• Transaction failures

Liability is limited to the last subscription fee paid.

19. Indemnification

You agree to indemnify AQARIRAQ against:

• Claims arising from your listings
• Legal violations or misuse

20. No Dispute Handling

We do not intervene in disputes.

21. Data Use

We may:

• Store personal and document data
• Share with authorities if required

22. Force Majeure

AQARIRAQ shall not be liable for any failure, interruption, or delay in performance resulting from events beyond its reasonable control, including but not limited to:

• Acts of God
• Government actions or restrictions
• War, civil unrest, or terrorism
• Internet or telecommunications failures
• Cyberattacks or security breaches
• Power outages
• Natural disasters

Such events shall not constitute a breach of these Terms.

23. Account Suspension

We may suspend or terminate accounts at any time.

24. Amendments

Terms may be updated at any time. Continued use constitutes acceptance.

25. Dispute Resolution (Mediation Before Court)

In the event of any dispute arising from or related to these Terms or the use of the Platform:

• The parties agree to first attempt to resolve the dispute amicably through good-faith negotiation
• If unresolved, the dispute shall be submitted to mediation in Basra, Iraq, conducted in accordance with applicable Iraqi procedures
• Only if mediation fails, the dispute may be brought before the competent courts of Basra, Iraq
